Welcome to QuickCrew! Please read the following terms and conditions carefully.

By accessing or using our platform, you agree to be bound by these terms. This document outlines the rules and regulations governing your use of QuickCrew, connecting businesses with casual staff in New Zealand, and beyond.


Terms of Use

Effective Date: May 2026

These Terms of Use ("Terms") govern your access to and use of the QuickCrew website, mobile application, and any related services (collectively, the Platform).

By creating an account, accessing the Platform, posting a Job Brief, accepting a Shift, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and QuickCrew Limited (NZBN 9429052799631)("QuickCrew", "we", "our", or "us").

1. About QuickCrew

QuickCrew is a New Zealand technology platform that connects businesses requiring temporary staff with workers seeking casual employment opportunities.

QuickCrew provides the technology that enables Businesses to advertise temporary work opportunities ("Job Briefs"), Workers to apply for and accept available Shifts, and both parties to manage bookings, communications, attendance and timesheets through the Platform.

Unless expressly stated otherwise, QuickCrew is not a recruitment agency acting on behalf of Businesses, nor is it an employment agency placing workers directly with Businesses. QuickCrew employs Workers who perform work assignments for Businesses through the Platform under separate employment arrangements with QuickCrew.

2. Acceptance of these Terms

These Terms apply to every person or entity accessing or using the Platform, including:

  • Businesses;
  • Workers;
  • authorised users of Business accounts;
  • visitors to the Platform.

You accept these Terms by:

  • creating an account;
  • clicking "I Agree", "Accept", or similar;
  • posting or accepting a Job Brief;
  • accessing or using any part of the Platform.

If you are accepting these Terms on behalf of a company or organisation, you warrant that you have authority to bind that entity.

3. Definitions

Unless the context requires otherwise:

Account means a registered user account created on the Platform.

Business means a company, sole trader, partnership or organisation registered with QuickCrew to request Workers through the Platform.

Business Day means any day other than a Saturday, Sunday or public holiday in New Zealand.

Job Brief means a request created by a Business describing the work, location, hours, pay category and any other relevant requirements for a Shift.

Platform means the QuickCrew website, mobile application and any software, systems or services operated by QuickCrew.

QuickCrew means QuickCrew Limited (NZBN 9429052799631).

Services means the services provided by QuickCrew through the Platform.

Shift means a work offered by the Business through the Platform.

Worker means an individual registered with QuickCrew who has entered into an employment agreement with QuickCrew and may accept Shifts through the Platform.

Work Site means the location where a Shift is performed.

4. Eligibility

To use the Platform you must:

  • be at least 16 years old;
  • have legal capacity to enter into contracts;
  • provide accurate and complete information;
  • keep your information up to date;
  • comply with all applicable New Zealand laws.

Businesses warrant that they have authority to engage temporary workers and enter into these Terms.

Workers warrant that they have the legal right to work in New Zealand and will provide all documentation reasonably requested by QuickCrew.

QuickCrew may request verification of identity, business registration, immigration status, qualifications or licences at any time.

Failure to provide requested information may result in suspension or termination of your Account. 

5. User Accounts

Users must create an Account before accessing certain features of the Platform.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity occurring under your Account;
  • ensuring your Account information remains accurate.

You must immediately notify QuickCrew if you believe your Account has been accessed without authorisation.

QuickCrew may suspend, restrict or terminate any Account where it reasonably believes:

  • these Terms have been breached;
  • fraudulent activity has occurred;
  • false information has been provided;
  • continued access may expose QuickCrew, Workers or Businesses to unacceptable risk.

QuickCrew reserves the right to refuse registration or remove Accounts at its discretion where reasonably necessary to protect the integrity, security or reputation of the Platform.

6. Platform Services

QuickCrew provides an online marketplace designed to facilitate temporary staffing arrangements between Businesses and Workers.

The Platform allows Businesses to:

  • create Job Briefs;
  • request temporary Workers;
  • manage bookings;
  • approve timesheets;
  • communicate with Workers;

The Platform allows Workers to:

  • maintain a profile;
  • browse available Shifts;
  • accept or decline Job Briefs;
  • record attendance;
  • submit timesheets.

QuickCrew may modify, improve, suspend or discontinue any feature of the Platform at any time.

While QuickCrew aims to provide continuous availability, we do not guarantee uninterrupted access to the Platform. Temporary interruptions may occur due to maintenance, upgrades, technical failures or events beyond our reasonable control.



7. Business Accounts

7.1 Business Registration

To access Business features of the Platform, a Business must create an Account and provide all information reasonably requested by QuickCrew.

The Business warrants that all information provided is complete, accurate and current.

QuickCrew may require:

  • verification of the Business's identity, 
  • legal status, 
  • New Zealand Business Number (NZBN), 
  • GST registration (if applicable), 
  • directors and authorised representatives, 
  • trading history,
  • proof of compliance with all Health and Safety requirements,
  • or any other information reasonably necessary to comply with legal obligations or to protect the Platform. 

The Business must promptly notify QuickCrew of any material changes to its information.

7.2 Authorised Users

A Business may permit employees or authorised representatives to access its Account.

The Business is solely responsible for:

  • determining who may access its Account;
  • maintaining appropriate internal access controls;
  • ensuring authorised users comply with these Terms.

Any action performed using a Business Account will be deemed to have been authorised by the Business.

7.3 Business Responsibilities

Businesses agree to:

  • provide accurate Job Briefs;
  • maintain a safe workplace;
  • comply with all applicable employment, health and safety and privacy legislation;
  • supervise Workers while they are performing a Shift;
  • treat Workers respectfully and without discrimination;
  • comply with all payment obligations.

Businesses must not:

  • provide misleading Job Briefs;
  • request Workers to perform duties materially different from those described in the Job Brief;
  • require Workers to perform unlawful or unsafe work;
  • circumvent the Platform.

8. Worker Accounts

Workers must complete the registration process and provide all information requested by QuickCrew.

QuickCrew may require evidence of:

  • identity;
  • age;
  • right to work in New Zealand;
  • qualifications;
  • licences;
  • certifications;
  • work history;
  • references.

QuickCrew may verify any information supplied by a Worker.

Providing false or misleading information constitutes a material breach of these Terms.

Registration on the Platform does not guarantee that a Worker will receive any Shifts.

QuickCrew has no obligation to provide any minimum number of work opportunities.

9. Job Briefs

Businesses may create Job Briefs through the Platform.

Each Job Brief should include, where applicable:

  • work location;
  • date and time;
  • estimated duration;
  • role category;
  • number of workers required;
  • required qualifications;
  • hourly rate;
  • dress requirements;
  • health and safety requirements;
  • any other information reasonably necessary for Workers to perform the Shift.

Businesses remain responsible for ensuring all information contained within a Job Brief is accurate.

QuickCrew reserves the right to reject, amend or remove any Job Brief that:

  • breaches these Terms;
  • contains unlawful content;
  • creates unacceptable health or safety risks;
  • is misleading or inaccurate.

10. Shift Acceptance

Workers may browse available Job Briefs and accept Shifts through the Platform.

A Shift is not confirmed until:

  • the Worker accepts the Shift;
  • the Business has approved the worker when shifts have been created with approval required

Previous to accepting a shift, a worker will be required to confirm having read and accepted the Terms and Conditions, confirmed having no Criminal Records and have understood and accepted the Cancellation Policy.

QuickCrew reserves the right to withdraw or reallocate any Shift where reasonably necessary, including where:

  • operational requirements change;
  • the Business cancels the Shift;
  • health and safety concerns arise;
  • a Worker becomes unavailable;
  • the Worker no longer satisfies eligibility requirements.

QuickCrew does not guarantee that any Worker will be offered Shifts or that any Business will receive Workers for every Job Brief.

11. Cancellations

11.1 Business Cancellations

Businesses may cancel Shifts through the Platform.

Where a Business cancels a Shift within the applicable notice period, cancellation fees may apply in accordance with QuickCrew's Cancellation Policy agreed with that Business.

11.2 Worker Cancellations

Workers should only accept Shifts they genuinely intend to complete.

If a Worker is unable to attend a Shift, they must notify QuickCrew immediately through the Platform or by any alternative contact method advised by QuickCrew.

Repeated late cancellations, failures to attend ("No Shows") or other unreliable conduct may result in:

  • temporary suspension;
  • reduced access to future Shifts;
  • permanent removal from the Platform.

The Worker acknowledges that the Worker Cancellation Policy is made available through the Platform each time a Shift is accepted, and by accepting the Shift, the Worker agrees to be bound by that policy.

12. Timesheets

Unless otherwise agreed, Workers must record their hours worked using the Platform.

Businesses are responsible for reviewing submitted timesheets promptly.

Where a Business does not approve or dispute a timesheet within the specified approval period, QuickCrew may rely on:

  • clock-in data;
  • communications;
  • Worker records;
  • other reasonable evidence

to determine hours worked.

The Business agrees that QuickCrew's reasonable determination of hours worked will be binding unless clear evidence demonstrates otherwise.

The applicable approval period for timesheets will be specified in the agreement between QuickCrew and the business.

13. Fees and Payment

The amount displayed on a Shift represents the payment to be received by the Worker.

Businesses agree to pay QuickCrew all applicable fees in accordance with the agreement between QuickCrew and the Business.

Unless otherwise agreed, fees may include:

  • Worker wages;
  • Holiday Pay;
  • KiwiSaver contributions (where applicable);
  • ACC levies;
  • statutory employment costs;
  • service fees;
  • GST (where applicable).

QuickCrew reserves the right to amend its pricing structure by providing reasonable notice.

Businesses authorise QuickCrew to process payments using the payment method registered to their Account.

Late payments may incur:

  • interest;
  • debt recovery costs;
  • suspension of Platform access.

QuickCrew guarantees to process workers payments fortnightly.

14. One-Time Absorption Fee

14.1 Workers introduced to a Business through the Platform are valuable commercial relationships developed by QuickCrew.

Accordingly, a Business must not directly or indirectly engage, employ or contract a Worker introduced through the Platform except in accordance with this clause.

14.2 If a Business wishes to employ or engage a Worker directly within 3 weeks of the Worker's last Shift performed through QuickCrew, the Business must:

  • notify QuickCrew in writing before making the offer; and
  • pay the applicable One-Time Absorption Fee.

14.3 The One-Time Absorption Fee will be the amount published by QuickCrew or otherwise agreed in writing before the direct engagement occurs.

14.4 This clause applies whether the Worker is engaged:

  • as an employee;
  • as an independent contractor;
  • through another entity;
  • through a related company;
  • through a labour hire provider;
  • through any arrangement intended to avoid payment of the One-Time Absorption Fee

14.5 This clause does not apply where the Worker independently applies through a genuine public recruitment campaign that was not targeted at the Worker because of their prior engagement through QuickCrew.

15. Employment Relationship

15.1 Workers are employed by QuickCrew

Unless expressly agreed otherwise in writing, all Workers performing Shifts through the Platform are employees of QuickCrew.

Nothing in these Terms creates an employment relationship between a Business and a Worker solely because the Worker performs a Shift for that Business through the Platform.

QuickCrew remains responsible for its obligations as employer under applicable New Zealand employment legislation, including (where applicable):

  • payment of wages;
  • PAYE deductions;
  • KiwiSaver obligations;
  • ACC obligations;
  • statutory leave entitlements;
  • employment records.

15.2 No Guarantee of Work

Nothing in these Terms guarantees:

  • any minimum number of Shifts;
  • ongoing work;
  • continued availability of Workers;
  • continued access to Businesses.

All work opportunities remain subject to operational requirements.

 

16. Health and Safety

16.1 Business Responsibilities

The Business acknowledges that it controls the Work Site and is therefore responsible for providing a safe working environment.

Without limitation, the Business must:

  • comply with the Health and Safety at Work Act 2015;
  • identify and manage workplace hazards;
  • provide appropriate induction before work begins;
  • provide any required Personal Protective Equipment (PPE);
  • ensure Workers receive appropriate supervision;
  • ensure equipment is safe and properly maintained;
  • investigate workplace incidents;
  • immediately notify QuickCrew of any serious incident involving a Worker.

16.2 Worker Responsibilities

Workers agree to:

  • take reasonable care for their own health and safety;
  • comply with lawful safety instructions;
  • correctly use PPE;
  • immediately report hazards, injuries and unsafe practices to QuickCrew and the business;
  • refrain from working while impaired by alcohol or drugs.

16.3 Right to Refuse Unsafe Work

QuickCrew may immediately withdraw a Worker from any Work Site where it reasonably believes continued work presents an unacceptable health or safety risk.

QuickCrew may suspend future services to a Business until those concerns have been adequately addressed.

 

17. Standards of Conduct

All Users must behave professionally while using the Platform.

Users must not:

  • harass, bully or discriminate against another user;
  • upload false information;
  • misuse the Platform;
  • interfere with Platform security;
  • attempt to gain unauthorised access;
  • introduce malware;
  • impersonate another person;
  • damage the reputation of QuickCrew.

Businesses must treat Workers fairly and respectfully.

Workers must behave professionally while representing QuickCrew at every Work Site.

Serious misconduct may result in immediate suspension or permanent removal from the Platform.

18. Acceptable Use of the Platform

Users agree not to:

  • copy or reproduce the Platform;
  • reverse engineer the Platform;
  • scrape Platform data;
  • use automated software or bots without permission;
  • attempt to bypass Platform security;
  • interfere with other users' access.

QuickCrew may investigate suspected misuse and take any action reasonably necessary to protect the Platform.

 

19. Intellectual Property

All intellectual property rights in the Platform remain the exclusive property of QuickCrew or its licensors.

This includes, without limitation:

  • software;
  • source code;
  • databases;
  • trademarks;
  • logos;
  • branding;
  • graphics;
  • text;
  • designs;
  • algorithms;
  • business processes.

Nothing in these Terms transfers ownership of any intellectual property to a User.

QuickCrew grants Users a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose.

20. User Content

Users retain ownership of content they upload to the Platform.

By uploading content, Users grant QuickCrew a worldwide, royalty-free licence to use, reproduce, store and display that content to the extent reasonably necessary to:

  • operate the Platform;
  • provide the Services;
  • comply with legal obligations;
  • resolve disputes.

Users warrant that they have the necessary rights to upload all content submitted to the Platform.

21. Confidentiality

Businesses and Workers may receive confidential information while using the Platform. Each User agrees to keep confidential all non-public information relating to:

  • QuickCrew;
  • Businesses;
  • Workers;
  • customers;
  • commercial operations.

Confidential information must not be disclosed except:

  • with prior written consent;
  • where required by law;
  • where reasonably necessary to perform obligations under these Terms.

These obligations survive termination of these Terms.

22. Privacy

QuickCrew collects, uses, stores and discloses personal information in accordance with:

  • the Privacy Act 2020 (NZ); and
  • QuickCrew's Privacy Policy.

Users acknowledge that QuickCrew may collect personal information necessary to:

  • verify identity;
  • administer Accounts;
  • facilitate Shifts;
  • process payments;
  • comply with legal obligations;
  • improve Platform functionality;
  • prevent fraud.

Users are responsible for ensuring that any personal information they provide is accurate and up to date.

23. Warranties and Disclaimers

23.1 Platform Availability

QuickCrew will use reasonable efforts to make the Platform available at all times. However, we do not guarantee that the Platform will be uninterrupted, error-free, secure or available at all times.

The Platform may occasionally be unavailable due to maintenance, upgrades, technical issues or circumstances beyond our reasonable control.

23.2 No Guarantee of Outcomes

QuickCrew does not guarantee that:

  • a Business will successfully fill every Job Brief;
  • a Worker will obtain any particular Shift;
  • a Worker will be suitable for every role;
  • the Platform will meet every User's requirements.

Businesses remain responsible for determining whether a Worker is suitable for their operational requirements.

23.3 Information Provided by Users

QuickCrew relies on information provided by Businesses and Workers.

Although QuickCrew may undertake identity, qualification or right-to-work verification where appropriate, QuickCrew does not warrant the completeness or accuracy of information supplied by Users.

Users remain solely responsible for the information they provide.

24. Limitation of Liability

To the maximum extent permitted by New Zealand law, QuickCrew's total aggregate liability arising out of or in connection with these Terms or the Platform shall not exceed the total service fees paid by the Business to QuickCrew during the six (6) months immediately preceding the event giving rise to the claim.

To the extent permitted by law, QuickCrew shall not be liable for any indirect, incidental, consequential, exemplary or special loss or damage, including:

  • loss of profits;
  • loss of revenue;
  • loss of business opportunity;
  • loss of goodwill;
  • loss of data;
  • business interruption.

Nothing in these Terms excludes liability that cannot lawfully be excluded under New Zealand law.

25. Indemnity

Businesses agree to indemnify and hold harmless QuickCrew, its directors, officers, employees and agents from any loss, liability, claim, damage or expense arising from:

  • breach of these Terms;
  • unsafe workplace conditions;
  • inaccurate Job Briefs;
  • unlawful instructions given to Workers;
  • negligence of the Business;
  • breach of applicable legislation.

Workers agree to indemnify QuickCrew against losses arising from:

  • fraudulent conduct;
  • deliberate misconduct;
  • unlawful acts;
  • material breach of these Terms.



26. Suspension and Termination

QuickCrew may suspend or terminate any Account immediately where it reasonably believes that:

  • these Terms have been breached;
  • fraudulent conduct has occurred;
  • false information has been supplied;
  • continued access presents legal, operational or reputational risk;
  • required payments remain outstanding;
  • a User has engaged in abusive, discriminatory or unsafe behaviour.

Where appropriate, QuickCrew may provide the User with an opportunity to remedy the breach before termination.

Termination of an Account does not affect any accrued rights or obligations existing before termination.

27. Force Majeure

QuickCrew shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including:

  • natural disasters;
  • severe weather;
  • pandemics;
  • industrial action;
  • government action;
  • telecommunications failures;
  • cyber incidents;
  • power outages;
  • internet failures.

QuickCrew will use reasonable efforts to resume normal operations as soon as reasonably practicable.

 

28. Electronic Communications

Users consent to receiving communications electronically, including:

  • notices;
  • invoices;
  • payment confirmations;
  • account notifications;
  • legal notices;
  • updates to these Terms.

Electronic communications satisfy any legal requirement that such communications be in writing.

29. Changes to these Terms

QuickCrew may amend these Terms from time to time.

Where a change materially affects Users' rights or obligations, QuickCrew will provide reasonable notice through the Platform, email or other appropriate means.

Continued use of the Platform after the effective date of the updated Terms constitutes acceptance of the revised Terms.

30. Dispute Resolution

Before commencing legal proceedings, the Parties agree to make reasonable efforts to resolve any dispute through good faith negotiations.

If a dispute cannot be resolved within 20 Business Days, either Party may refer the matter to mediation.

Nothing in this clause prevents either Party from seeking urgent interim or injunctive relief from a court of competent jurisdiction.

31. Governing Law

These Terms are governed by the laws of New Zealand.

The Parties submit to the non-exclusive jurisdiction of the courts of New Zealand.

32. General Provisions

Entire Agreement

These Terms constitute the entire agreement between QuickCrew and the User regarding the use of the Platform.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Failure by QuickCrew to enforce any provision does not constitute a waiver of that provision.

Assignment

Users may not assign or transfer their rights under these Terms without QuickCrew's prior written consent.

QuickCrew may assign its rights and obligations in connection with a merger, acquisition or business restructuring.

Survival

Clauses relating to confidentiality, privacy, payment obligations, intellectual property, limitation of liability, indemnities and dispute resolution survive termination of these Terms.
